Terms and Conditions |
By purchasing and/or by using our services,
you state that you agree to the following terms. Breaches of any of the
following standard terms and conditions will result in the immediate removal
of your site(s) from our servers. Any such removal does not release you
from your other legal obligations and liabilities to us as detailed below,
or as standard under UK law.
-
We do not host sites which contain adult or pornographic
content, or those which contain links to such sites. Similarly, sites
which may encourage others to act illegally - or contain content that
breaks UK laws - are prohibited.
-
Any attempt to gain unauthorised access to any system(s)
or parts of systems under our control is strictly forbidden. If you
attempt to compromise our network security, we will immediately deny
you further service. You are permitted access only to the areas of
our servers and systems to which we have expressly granted you such
access.
-
You are solely responsible for the contents of your
site. You agree to indemnify us against any legal or financial liabilities
howsoever incurred through your actions or use of our systems or our
hosting of your content.
-
We currently have no bandwidth useage restrictions
as a matter of policy. However you accept that we may change this policy
at any time and may do so for any individual customer at our discretion.
We also reserve the right to make additional charges for excessive bandwidth
useage - any excess useage charges will be notified to you before the
charge is made.
-
You agree to ensure that you (or your agents) collect
all mail sent to the 'admin' e-mail address of your domain ('admin@yoursite.co.uk').
E-mail sent to this address, or publication in this section of our site,
will be taken to construe official notification of any charges in policy
or pricing or terms and conditions.
-
We have a zero-tolerance policy on spam, junk mail
and similar newsgroup postings. We do not provide an SMTP relay and
you may not send unsolicited mail through our servers in any other manner,
nor send such mail that has a from or reply to address at a domain that
we host for you.
-
Registration of new domain names under the .uk namespace:
When you ask us to register a .uk domain name for you, in accordance
with the terms and conditions of Nominet UK, The Web Site Hosting Company
UK acts only as agent for you as an applicant and you enter into contracts
for the registration directly with NOMINET UK. You should read Nominet's
Terms and Conditions - they are available here.
-
Warranty: In the case of service complaints or issues
or problems with our service to you, you must notify us promptly of
any problems. We reserve the right to investigate any such complaints
to promptly resolve the problem or to determine whether such complaints
are proper. In the event that after repeated efforts we are unable to
provide a resolution, then your exclusive remedy and our entire liability
in contract, tort, or otherwise shall not exceed the purchase price
you have actually paid for our services.
-
The above warranty is in lieu of all other warranties,
expressed, implied or statutory, including without limitation those
of merchantability or fitness for a particular purpose, all of which
are expressly disclaimed. Nothwithstanding to the contrary we shall
not be liable for any consequential, incidental, special or exemplary
damages, even if we have been advised of the possibility of such damages.
-
You also waive your rights to pursue any current or
future claims of any liability whatsoever against us on all possible
grounds including but not exclusively failures in service, loss of business,
or any other such unspecified claims.
-
No statement, recommendation, description or warranty
presented in any document other than these terms and conditions, or
made verbally or in writing or otherwise by any agents or employees
of The Web Site Hosting Company UK shall be construed to enlarge, vary
or override any of these terms and conditions or our product specification
or the facilities and services described collectively on the pages of
this website that we may agree to provide to you as a customer.
-
These terms and conditions may be updated from time
to time, and any such variation will be published in this section of
our website and be effective immediately.
